EPA Sues Mining Cos. For Illegal Pollution

Law360, New York (November 14, 2008, 12:00 AM EST) -- The U.S. Environmental Protection Agency has sued three energy and mining companies for spilling pollution into federal water without a permit while conducting surface mining operations.

Apex Energy Inc., Cambrian Coal Corp. and Marshall Resources Inc. allegedly dumped dredged material, which has been excavated from federal waters, or fill material, which replaces a portion of U.S. waters with dry land, into tributaries to Kentucky's Buckhorn Creek and Dotson Fork while constructing three hollow fills on a coal mining site from December 2003 to January 2004....
