Retrospective Reviews Of Petroleum Industry Mergers

Law360, New York (November 14, 2008, 12:00 AM EST) -- On Sept. 25, 2008, the U.S. Government Accountability Office issued the results of its 18-month study entitled, Energy Markets: Analysis of More Past Mergers Could Enhance Federal Trade Commission’s Efforts to Maintain Competition in the Petroleum Industry.

The title reflects one of the GAO’s two recommendations: the FTC should conduct more regular retrospective analyses of past petroleum mergers.

The GAO further recommends that the FTC develop risk-based guidelines to determine when the retrospective analyses should be done.
