Case Challenging SOX Board Headed To High Court

Law360, New York (November 18, 2008, 12:00 AM EST) -- A case challenging the constitutionality of the accounting oversight board established by the Sarbanes-Oxley Act of 2002 is headed for the U.S. Supreme Court now that a federal appeals court has denied the plaintiffs' petition for a hearing en banc.

Libertarian lobbyist group Free Enterprise Fund and Nevada accounting firm Beckstead & Watts LLP plan to file a petition for writ of certiorari within 90 days, said Jones Day partner Chris Vergonis, who represented the plaintiffs with lead counsel Michael Carvin.
