Tyson Sluggish On Discovery In MDL: Plaintiffs

Law360, New York (November 19, 2008, 12:00 AM EST) -- The plaintiffs in a multidistrict litigation accusing Tyson Foods Inc. of violating the Fair Labor Standards Act have asked a judge to force the company to turn over relevant electronically stored information.

In a motion filed Tuesday in the U.S. District Court for the Middle District of Georgia, the plaintiffs said Tyson missed a Sept. 10 deadline to turn over some documentation.

While the company has not objected to producing the information and acknowledges that it should be responsive, it hasn't produced documentation so far....
