Aredia Judge Tosses More Failure-To-Warn Claims

Law360, New York (November 25, 2008, 12:00 AM EST) -- Novartis Pharmaceuticals Corp. has prevailed again in its ongoing bid to get failure-to-warn claims tossed from cases in the multidistrict litigation over its bone cancer drugs Aredia and Zometa.

The drugmaker won its motion for partial summary judgment dismissing the claims from 16 Texas-based plaintiffs in an order Monday, after arguing that federal law preempted the claims and shielded it from liability.
