Law360, New York (November 25, 2008, 12:00 AM ET) -- The U.S. Supreme Court heard a case Monday that attorneys believe could settle a long-simmering debate over the enforceability of arbitration clauses in collective bargaining agreements.
In 14 Penn Plaza LLC v. Pyett, the court will decide whether arbitration clauses in collective bargaining agreements that waive an employee's right to file statutory discrimination claims are enforceable. Lawyers said Monday that the case could clear up “inherent tensions” between other high court rulings on the matter.
