Solvay Sues USPTO Over Refusal To Extend Patent

Law360, New York (December 2, 2008, 12:00 AM EST) -- German drug manufacturer Solvay Pharmaceuticals GmbH has sued the U.S. Patent and Trademark Office over the office's refusal to extend the term of a patent for a chemical that could be used to treat high blood pressure and heart and kidney failure.

The complaint, filed Friday in the U.S. District Court for the District of Columbia, names USPTO and Under Secretary for Commerce for Intellectual Property Jon W. Dudas in its allegations that the office abused its discretion in refusing to reconsider its patent term adjustment...
