Warner Chilcott Sues To Protect Contraceptive Drug

Law360, New York (August 1, 2006, 12:00 AM EDT) -- Warner Chilcott Company Inc. has filed a patent infringement suit to protect the market for the oral contraceptive Loestrin 24 Fe, after a rival pharmaceutical company filed an Abbreviated New Drug Application seeking approval for a generic version of the drug.

The lawsuit, filed Friday in federal court in New Jersey, asks the court to declare that Watson Pharmaceuticals Inc. infringed on U.S. Patent No. 5,552,394—held by Warner Chilcott—when Watson filed an ANDA looking to market its own version of Loestrin.
