Del Monte Sues For Release Of Detained Cantaloupe

Law360, New York (December 15, 2008, 12:00 AM EST) -- Del Monte Fresh Produce NA has asked a federal judge to stop the U.S. Food and Drug Administration's “unlawful” and “unreasonable” detention of its cantaloupe shipments into the United States, saying that the company's cantaloupe has never tested positive for salmonella.

The suit, filed Friday in the U.S. District Court for the District of Columbia, alleges that FDA inspectors have been holding three separate shipments of cantaloupe from Guatemala since the beginning of December. The produce was becoming overripe, costing Del Monte up to $4.5 million...
