Judge OKs $4.5M Deal In Suit Over Choking Death

Law360, New York (December 15, 2008, 12:00 AM EST) -- A magistrate judge in New Mexico has recommended approval of a $4.5 million settlement pact in a case against Kmart Corp., Street Flyers LLC and Cycle Source Group LLC over a child who choked to death on a ball bearing allegedly contained in the package to a Spiderman bike made in China and purchased at Kmart.
