Fed. Circ. Issues Mixed Ruling In Apnea Patent Case

Law360, New York (December 16, 2008, 12:00 AM EST) -- An appeals court has affirmed in part and reversed in part a judge's ruling in a patent dispute between Invacare Inc. and Respironics Inc., two companies that make treatments for sleep apnea.

A lower court judge had found that Invacare did not infringe three patents held by Respironics but infringed one other. It found that all four patents were valid. The U.S. Court of Appeals for the Federal Circuit on Tuesday affirmed that Invacare had not infringed two of the patents.
