Buddha Bar Chain Wins Appeal In Trademark Fight

Law360, New York (January 8, 2009, 12:00 AM EST) -- A state appeals court dished out some vindication for owners of the international Buddha Bar restaurants embroiled in a trademark dispute, reversing a lower court’s decision in holding that a Manhattan operation bearing the same name requires a license to do so.

On Tuesday, the Appellate Division of the New York State Supreme Court held that the trial court improperly denied the owners of the federally registered Buddha Bar trademark an injunction because the use of the name inevitably caused confusion among consumers.
