High Court Won't Hear Ex-HealthSouth CFO Appeal

Law360, New York (January 12, 2009, 12:00 AM EST) -- A former chief financial officer of HealthSouth Corp. will once again be re-sentenced for his role in a massive corporate accounting scandal now that the U.S. Supreme Court has declined to hear his appeal.

The high court on Monday denied a petition for writ of certiorari filed by Malcom E. McVay, who was twice sentenced to probation for his role in an alleged scheme to artificially inflate company earnings by billions of dollars between 1994 and 2003.
