Judge OKs Class Settlement Over Defective Decking

Law360, New York (January 13, 2009, 12:00 AM EST) -- A federal judge has approved a class action settlement in a case that accused Weyerhaeuser Co. and Advanced Environmental Recycling Technologies Inc. of making defective deck products that later led to fungal, mold or mildew growth.

Judge John C. Coughenour of the U.S. District Court for the Western District of Washington signed off on the deal Friday.

The settlement calls for class members impacted by the alleged defect to receive a combination of free and discounted deck cleanings, applications of mold inhibitor, cash refunds, replacement products...
