Antitrust Suit Against 3M Gains New Life

Law360, New York (August 09, 2006, 12:00 AM ET) -- A U.S. Appeals Court panel on Tuesday reversed a lower court’s decision to dismiss the claims of now-defunct automotive abrasive company NicSand Inc., thus revitalizing its antitrust lawsuit against former rival 3M Co.

In its complaint, NicSand alleged that 3M unlawfully monopolized the market by arranging exclusive dealing contracts with four of the six largest distributors of do-it-yourself automotive abrasives.

NicSand did not manufacture the abrasives, including sandpaper, polishing discs and finishing paper, but instead purchased them in bulk, cut them and packaged them for retail...
