Law360, New York (January 20, 2009, 12:00 AM ET) -- Stryker Corp. has prevailed in its attempt to toss a putative antitrust class action alleging it masterminded a scheme to pay kickbacks to doctors and hospitals in exchange for using its products in patients undergoing hip or knee replacement surgery.
The medical device maker, which is facing a federal investigation into the alleged kickback scheme, was granted its motion to dismiss the suit in a ruling Friday by Judge Jeffrey White of the U.S. District Court for the Northern District of California.
