Amerisure Sues To Bar Wal-Mart Flood Suit Coverage

Law360, New York (January 22, 2009, 12:00 AM EST) -- In a dispute stemming from allegations that the construction of a Louisiana Wal-Mart store caused flooding to area properties, Amerisure Mutual Insurance Co. has sued for declaratory judgment stating that it does not owe the retail giant any liability coverage in the matter.

Amerisure Mutual and a related company, Michigan Mutual Insurance Co., filed a complaint against Wal-Mart Stores Inc. on Wednesday in the U.S. District Court for the Western District of Arkansas, contesting the retailer’s request for coverage of its flooding-related litigation costs.
