WildEarth To Sue FWS Over 21 Species' Protection

Law360, New York (January 28, 2009, 12:00 AM EST) -- Wildlife protection group WildEarth Guardians said Wednesday it planned to sue the U.S. Fish and Wildlife Service over the agency’s alleged failure to federally protect 21 endangered animals and plants under the Endangered Species Act.

The notices of intent to sue, which were sent to the acting director of FWS as well as U.S. Secretary of the Interior Ken Salazar, accuse FWS of failing to issue a required decision on whether 12 of the species warrant ESA protection, WildEarth said.
