Judge Cites Bad Faith Efforts, Ups Award In FMLA Suit

Law360, New York (January 30, 2009, 12:00 AM EST) -- A judge has more than doubled a jury's award of damages to a pregnant worker in an employment suit against Nutrition Management Services Co., ruling that a company attorney did not act in good faith in firing her.

Judge Norma L. Shapiro of the U.S. District Court for the Eastern District of Pennsylvania ordered NMS to pay Melissa Brown more than $160,000, more than twice the sum a jury awarded her after finding the company guilty of breaching the Family and Medical Leave Act.
