2nd Circ. Revives Nigerian Families' Case V. Pfizer

Law360, New York (January 30, 2009, 12:00 AM EST) -- Two groups of Nigerian families who claim Pfizer Inc. illegally used their children in a 1996 meningitis drug trial will be able to proceed with their lawsuits in the United States, an appeals court has ruled.

The U.S. Court of Appeals for the Second Circuit on Friday revived the two cases and sent them back to the district court, where they had earlier been dismissed for lack of subject matter jurisdiction under the Alien Tort Statute.
