SMIC Not Defrauded In TSMC Deal Dispute: Judge

Law360, New York (February 12, 2009, 12:00 AM EST) -- A state judge has shot down claims by Semiconductor Manufacturing International Corp. that it had been duped by Taiwan Semiconductor Manufacturing Co. into entering a 2005 settlement agreement resolving patent and trade secrets litigation.

In a proposed ruling on Tuesday, Judge Steven Brick of the Alameda County Superior Court in California found that TSMC and SMIC had in fact entered into an enforceable deal in which SMIC agreed to pay TSMC $175 million to bring an end to litigation in several forums that began in 2004....
