Fed. Circ. Nixes $8M Basketball Patent Verdict

Law360, New York (February 17, 2009, 12:00 AM EST) -- A federal appeals court has vacated an $8.1 million jury verdict against Molten USA Inc. for false advertising after finding that plaintiff Baden Sports Inc. should not have been allowed to bring its claim under the Lanham Act.

The U.S. Court of Appeals for the Federal Circuit on Friday reversed a lower court ruling denying Molten judgment as a matter of law in the case, which involves a dispute over a patent for high-end cushioned basketballs.
