BNSF Unit Ordered To Pay $345M In Coal Rate Case

Law360, New York (February 19, 2009, 12:00 AM EST) -- In the largest award of its kind, BNSF Railway Co. has been ordered to pay an estimated $345 million in reparations and rate reductions to two utilities it allegedly overcharged for the cost of transporting coal across Wyoming.

The Surface Transportation Board, which is part of the U.S. Department of Transportation, issued the order Wednesday in a long-running rate challenge Western Fuels Association Inc. and Basin Electric Power Cooperative Inc. first brought against the railroad in 2004.
