Generic Patent Challenges Up 19% In '08: Report

Law360, New York (February 19, 2009, 12:00 AM EST) -- The number of patent challenges generic-drug companies brought against their brand-name rivals has continued to increase in recent years, rising 19 percent in 2008 as generics makers become more aggressive in bringing copycat drugs to market, according to a Dow Jones analysis.

Generic-drug makers brought 51 patent challenges in 2008, up from 43 in 2007, the newswire reported on Thursday, citing data compiled by Stanford Group analyst Adam Greene. The number of challenges has risen steadily since 2003, when only 13 were filed, the report said....
