Plaintiffs Eye GHGs As Next 'Big' Mass Tort

Law360, New York (February 20, 2009, 12:00 AM ET) -- In the absence of federal climate change legislation, conservation groups, states and private citizens have turned to the courts, seeking to force the regulation of greenhouse gas emissions through mass tort and other claims.

So far, attempts to reduce GHGs in this way have not met with much success. But at least four mass tort cases are pending in circuit and district courts and numerous others have been brought using National Environmental Policy, Endangered Species and Clean Air Act claims.
