DOL Delays 'Popcorn Lung' Rules For Business Probe

Law360, New York (March 17, 2009, 12:00 AM EDT) -- The U.S. Department of Labor said Monday that it was withdrawing the advance notice of proposed rulemaking for diacetyl to allow an advocacy review panel to determine how small businesses could be affected by regulation of the flavoring chemical, which is linked to a lung disease.

Secretary of Labor Hilda L. Solis said the move would facilitate the Occupational Safety and Health Administration to timely develop a standard to protect workers from bronchiolitis obliterans, or "popcorn lung," which is associated with diacetyl exposure.
