Ex-Asst. Manager Fires Off OT Action Against Staples

Law360, New York (March 23, 2009, 12:00 AM EDT) -- A former assistant manager at Staples Inc. has hit the office supply megastore with a putative class action, claiming that the company failed to pay its assistant managers overtime wages.

Elminio Soto, formerly an assistant manager at an Owings Mills, Md., Staples store, filed the suit Friday in the U.S. District Court for the District of Maryland.

According to the suit, Staples attempted to exempt Soto's position from overtime wage requirements under the Fair Labor Standards Act and state law by labeling the position “assistant manager,”...
