Abercrombie Plaintiff Seeks Recusal In FLSA Suit

Law360, New York (March 30, 2009, 12:00 AM ET) -- The plaintiff’s counsel in a putative class action against Abercrombie & Fitch Stores Inc. has challenged the bench, claiming the federal judge appointed to the case finds workers’ Fair Labor Standards Act claims “a nuisance” and is incapable of administering justice.

The motion to disqualify or recuse Judge Kenneth L. Ryskamp, filed Friday in the U.S. District Court for the Southern District of Florida, claims the judge has expressed a general antipathy for overtime claims and a particular disdain for the firm representing the plaintiff....
