Judge Bails From Abercrombie OT Class Action

Law360, New York (March 31, 2009, 12:00 AM ET) -- Succumbing to concerns plaintiff's counsel raised about his ability to hear the case without prejudice, the federal judge overseeing a Fair Labor Standards Act putative class action against Abercrombie & Fitch Stores Inc. has recused himself.

Judge Kenneth L. Ryskamp of the U.S. District Court for the Southern District of Florida inked an order of recusal Monday, acceding to claims that his professed antipathy for FLSA litigation in general and disdain for the Shavitz Law Group in particular colored his judgment.
