Plaintiffs Seek Class Cert. In ERISA Suit V. BorgWarner

Law360, New York (April 06, 2009, 12:00 AM ET) -- The lead plaintiffs have moved for class certification in a suit accusing auto parts maker BorgWarner Inc. of violating the Employee Retirement Income Security Act by attempting to eliminate post-retirement health care benefit plans for workers at a soon-to-close factory.

The four lead plaintiffs lodged the motion for class certification Friday in the U.S. District Court for the Eastern District of Michigan on behalf of about 1,750 hourly retirees and surviving spouses from BorgWarner's Muncie, Ind., plant, which is set to close April 24.
