Law360, New York (April 08, 2009, 12:00 AM ET) -- Bayer AG has won summary judgment against two plaintiffs in the product liability litigation over Bayer Corp.'s cholesterol-lowering drug Baycol, further shrinking the pool of about 100 plaintiffs remaining in the case.
In two orders entered Wednesday, Judge Michael J. Davis of the U.S. District Court for the District of Minnesota found that the two plaintiffs relied on inadmissible expert testimony, and therefore could not show that they were injured by the drug.
