PTO Rejects Bulk Of Biosig Heart Rate Monitor Patent

Law360, New York (April 16, 2009, 12:00 AM EDT) -- Less than nine weeks after agreeing to re-examine a heart rate monitor patent, the U.S. Patent and Trademark Office has issued a first action citing a bevy of prior art in rejecting all but one of 16 claims of a Biosig Instruments Inc. patent that the company asserted against fitness equipment maker Nautilus Inc.

In the first office action issued Monday, the USPTO pointed to Biosig materials — including a trademark application and published information on the company's products — in support of its decision....
