Food Co.'s Bad Faith Case Crumbles Before 2nd Circ.

Law360, New York (April 20, 2009, 12:00 AM EDT) -- A federal appeals court has affirmed a win for Maryland Casualty Co. in food company Tradin Organics USA Inc.'s $850,000 case claiming that its contaminated Raspberry Crumble product was covered by an insurance policy.

The “your product” exclusions in the insurance held by plaintiff Tradin Organics excluded the claim, the U.S. Court of Appeals for the Second Circuit ruled, affirming a lower court's grant of summary judgment for the insurer.
