Reps Win Conditional Cert. In OT Suit V. AT&T Unit

Law360, New York (April 21, 2009, 12:00 AM EDT) -- Finding that customer service representatives seeking unpaid wages from an AT&T Inc. unit have adequately shown they were victims of a single decision, policy or plan, a federal judge has granted them conditional collective action status.

Judge Eric F. Melgren of the U.S. District Court for the District of Kansas on Monday signed an order granting the lead plaintiffs' motion for conditional class certification for their claims against Southwestern Bell Telephone Co. under the Fair Labor Standards Act and approving their proposed notice.
