Genzyme Sues Eagle Pharma Over Hectorol ANDA

Law360, New York (April 24, 2009, 12:00 AM EDT) -- Biotechnology firm Genzyme Corp. has filed a lawsuit accusing Eagle Pharmaceuticals Inc. of infringing a method patent for the use of hormone disorder drug Hectorol by seeking approval to sell a generic version of the treatment.

On Thursday, Genzyme and its wholly owned company Bone Care International LLC filed suit in the U.S. District Court for the District of Delaware, alleging infringement of U.S. Patent Number 5,602,116, titled “Method for treating and preventing secondary hyperparathyroidism” and owned by Bone Care.
