Merck-Medco Dropped From Vioxx ERISA Litigation

Law360, New York (April 24, 2009, 12:00 AM ET) -- Merck & Co.'s pharmacy benefits management subsidiary has been dropped from multidistrict securities litigation filed under the Employee Retirement Income Security Act over the drugmaker's shelved painkiller Vioxx.

The plaintiffs submitted a stipulation of dismissal Thursday in the U.S. District Court for the District of New Jersey, dropping without prejudice the remaining communication claim against Merck-Medco Managed Care LLC.
