Insurer Tries To Renege On Port's Enviro Suit Defense

Law360, New York (April 28, 2009, 12:00 AM EDT) -- After initially agreeing to provide a defense, an insurer has sued the San Diego Unified Port District claiming it has no duty to defend or indemnify the district in connection with an underlying $12 million environmental mediation contract lawsuit.

Maryland-based United States Fidelity and Guaranty Co. filed suit Monday in the U.S. District Court for the Southern District of California, contending it has no duty to defend the port in an action that, according to the complaint, has cost $100,000 to litigate so far.
