Obama Officially Kills Bush-Era ESA Rules

Law360, New York (April 28, 2009, 12:00 AM EDT) -- Two federal departments have formally revoked last-minute rules issued by former President Bush that allowed federal agencies to avoid consulting with government scientists about projects that could affect endangered species.

Commerce Secretary Gary Locke and Interior Secretary Ken Salazar announced Tuesday that they had struck down the regulations, and federal agencies once again must consult with federal wildlife experts at the U.S. Fish and Wildlife Service and the National Oceanic and Atmospheric Administration before taking any action that may impact endangered species.
