Tellabs Wins Appeal Over Mandatory Unpaid Time Off

Law360, New York (April 29, 2009, 12:00 AM EDT) -- An Illinois appellate court has ruled that Tellabs Inc.’s policy of requiring employees to take unpaid days off near each paid holiday does not entitle exempt workers to collect overtime.

The ruling, passed down Monday in the Illinois Appellate Court, First Division, affirmed a judgment from the Circuit Court of Cook County that found that Tellabs’ policy was imposed because of “bona fide business needs" and did not violate the Illinois Minimum Wage Law.
