Insurer Must Defend Fluor In La. Mud Hole Suit: Court

Law360, New York (April 30, 2009, 12:00 AM EDT) -- United National Insurance Co. must defend contractor Fluor Enterprises Inc. in a $14 million lawsuit over allegations of botching a job at a Louisiana trailer park and leaving behind a mud hole, a federal judge has ruled.

Judge Patricia Minaldi of the U.S. District Court for the Western District of Louisiana on Thursday rejected the insurer's contention that claims in an underlying lawsuit against the engineering and construction firm amounted to accusations of breach of contract and were therefore excluded from coverage.
