Law360, New York (May 05, 2009, 12:00 AM ET) -- The Iowa Supreme Court has upheld sanctions against an attorney for launching an allegedly frivolous and abusive class action against Tamko Roofing Products Inc. and its president over defective roofing tiles.
Voicing the majority opinion, Judge Michael J. Streit of the Iowa high court concluded that the district court did not abuse its discretion when slapping attorney Kathryn S. Barnhill with $25,000 in sanctions for pursuing claims “a reasonably competent Iowa attorney would not have” and subsequently violating state civil procedure.
