Law360, New York (September 18, 2009, 4:56 PM ET) -- A federal judge has refused to release Wachovia Corp. from a racketeering lawsuit filed by the liquidation trustee for bankrupt beverage company Le-Nature's Inc., alleging that the bank and others aided a fraudulent scheme piloted by Le-Nature's former CEO.
In an order issued Wednesday, Judge Donetta W. Ambrose of the U.S. District Court for the Western District of Pennsylvania refused Wachovia's bid to toss all claims made against the bank, agreeing only to boot a breach of fiduciary duty allegation from the suit.
