Lehman Judge Cracks Open Door For BNY Appeal

Law360, New York (June 30, 2010, 5:40 PM ET) -- A bankruptcy judge has offered hope to Bank of New York Mellon Corp. in its so-far stymied efforts to appeal a ruling preserving a Lehman Brothers Holdings Inc. affiliate's priority rights to $70 million in swap collateral.

Judge James Peck said from the bench Wednesday in the U.S. Bankruptcy Court for the Southern District of New York that he would submit a final order in Lehman Brothers Special Financing Inc.'s adversary case against BNY, a step that could allow the bank to file its appeal....
