BofA, Ex-CEO Fight Cuomo Fraud Case

Law360, New York (August 20, 2010, 6:40 PM ET) -- Bank of America Corp. and former CEO Kenneth Lewis are contesting claims brought by New York’s attorney general that they duped shareholders and the government during the bank’s takeover of Merrill Lynch & Co.

Lewis on Wednesday lodged his response to New York Attorney General Andrew Cuomo’s civil fraud suit in the New York County Supreme Court, claiming the suit alleged without basis that he took part in a conspiracy to conceal Merrill’s financial decline and Bank of America’s motivation to gain government aid.
