Parmalat Judge Reinstates Counterclaim

Law360, New York (May 30, 2007, 12:00 AM ET) -- Admitting a court error, a federal judge has reversed an earlier decision to toss out Grant Thornton's spoliation counterclaim in the Parmalat securities litigation, keeping the accounting firm's hopes of pursuing its document destruction case against the Italian dairy giant alive.

U.S. District Judge Lewis Kaplan reinstated Grant Thornton's claim at the end of last week, holding off on a decision until briefing is completed on the defendants' motion to dismiss.
