Law360, New York (September 09, 2011, 7:58 PM ET) -- The First Circuit on Friday affirmed a lower court's ruling granting an American Express Co. unit summary judgment in a multimillion-dollar contract and damages case brought by The Capability Group Inc. over fee payments for Six Sigma training.
A three-judge panel of the appeals court said Boston-based Capability had failed to provide evidence showing that American Express Travel Related Services Co. Inc. had breached a contract by failing to pay full compensation.
