Law360, New York (April 26, 2012, 10:10 PM ET) -- Cottonwood Financial Ltd. fought to reverse a ruling that the payday lender discriminated against a bipolar store manager, saying Tuesday that the U.S. Equal Employment Opportunity Commission offered no proof that the company regarded the worker as disabled.
In a motion for a new trial filed in Washington federal court, Cottonwood, which does business as The Cash Store, also said the EEOC failed to prove that the company had a fair opportunity to address worker Sean Reilly's discrimination allegations prior to litigation.
