Law360, New York (May 11, 2012, 7:54 PM ET) -- The New Jersey Supreme Court is poised to examine when a plaintiff can maintain a common law, noncustomer negligence claim against a bank, according to a decision released Thursday.
In December, the state's appellate division overturned a trial court ruling dismissing the noncustomer claims of Brendan Allen, a partner in a material hauling venture gone awry, against Oritani Savings Bank.
The state Supreme Court granted certification to Oritani on the question of whether Allen can bring such a negligence claim.
