Law360, New York (July 26, 2012, 8:49 PM ET) -- The Federal Circuit on Thursday upheld a lower court's finding that two of Bancorp Services LLC's insurance calculation patents were invalid, saying the patents were too abstract to be protected even though they required a computer to function.
The appeals court affirmed the trial court's ruling last year that Bancorp's invalid patents couldn't be asserted against Sun Life Assurance Co. of Canada, saying Bancorp's patents covering a method for determining underwriting values related to certain insurance policies were no more concrete for supposedly requiring a computer....
