DOJ Probes AmEx Merchant Agreement Policies

Law360, New York (October 31, 2008, 12:00 AM ET) -- The U.S. Department of Justice has asked American Express Co. for information relating to the credit card issuer's merchant surcharge and anti-steering policies, both of which have also been targets of antitrust litigation in recent months.

The request from the DOJ's Antitrust Division came Oct. 14 in the form of a civil investigative demand for documents or other information related to the policies, the company said in a quarterly filing with the U.S. Securities and Exchange Commission on Friday.
